Overview

The area of employment law in Malaysia has always known to be pro-employees. Foreign investors who entered into the Malaysia market usually find themselves unaware or not well-informed about the differences in human resource practice and management in Malaysia. Making a mistake in such practice can be costly to employers if an industrial action is subsequently commenced by employees against them. As companies consider establishing offices in Malaysia, it is important for business owners and senior management of companies to have the fundamental understanding of labour practices and are compliant with the local labour laws.

This ½ day workshop will focus on the relevant and accurate application of employment laws in Malaysia and the critical changes that have taken place in respect of those laws. There will also be a brief sharing on the “S” in ESG and how this has impacted employers in Malaysia.

During this ½ day session, participants will be guided on the following :

1. Differences between Employment Act 1955 (EA) covered employees and Non-EA employees
2. Critical changes that are being made / proposed in respect of the EA
3. Managing performance
4. Redundancies
5. Sharing of "S" in ESG - discussion on modern slavery issues
6. Case studies and discussions

Programme/Agenda

At the end of the workshop, participants would be able to :

  • tell the differences between Industrial Relations Act (1967) and the Employment Act (1955)
  • recognise the liability exposure faced by employers when employees' performance and redundancies are not managed properly
  • see the changes and amendments in respect of the EA
