RISE Safeguarding Personal Data For Businesses

Overview

Increasingly, businesses are finding ways to seize new opportunities and embrace digitalisation. While digitalisation can help accelerate business renewal, there are also potential challenges faced by businesses in relation to safeguarding personal data and confidential information. Today's rapidly evolving technologies have made it easier than ever for companies to collect, use and transfer personal data in Singapore and throughout the world. It is therefore important for businesses to understand the regulation of personal data, their key obligations in relation to protecting that personal data and the potential negative impacts that failing to meet such obligations may have on their business.

Course Outline

Key areas which are important for businesses to consider when safeguarding personal data :

1. Key obligations under Singapore's Personal Data Protection Act (PDPA) for all businesses operating in Singapore

2. New amendments to the PDPA and its impact on businesses :
- increased financial penalties
- mandatory data breach notification

3. PDPA vs General Data Protection Regulation (GDPR)
- analyse the differences (and aimilarities) between the amended PDPA and the EU GDPR for businesses which is useful for any Singapore business that plans to sell goods or services to EU customers

4. Data Protection Impact Assessments (DPIAs)
- when a DPIA is required 
- how a DPIA should be run
- Personal Data Protection Commission (PDPC) Guidance on DPIAs
- how the Singapore approach compares to GDPR requirements

5. Use of New Consent Exceptions
- collection, use and disclosure of personal data without consent

Arwen is the local principal in the Intellectual Property and Technology (IPTech) Practice Group of Baker McKenzie Wong & Leow. She regularly advises global clients on cross-border information technology, intellectual property, telecommunications and data protection matters, particularly for clients in the EU and in Asia Pacific on complex cross-border data protection issues. Arwen also works with business on high value, strategically important IT rollouts and digital transformation projects in heavily regulated sectors. She helps clients successfully navigate legal and regulatory landscapes to roll out innovative technology solutions in a diverse range of sectors (including life sciences, financial services, energy, telecoms and advanced manufacturing).

Senior Associate, Baker McKenzie Wong & Leow

Sanil is the Senior Associate in the Intellectual Property & Technology (IPT) practice group of Baker McKenzie Wong & Leow. He specialises in respect of the commercialisation of IP and related commercial matters, including privacy, data protection, licensing, franchising, transactions, e-commerce and regulatory issues in a range of industries including technology, media, telecoms, consumer goods, manufacturing, healthcare, fashion and luxury goods. Sanil also advises in intellectual property law, representing and advising local, regional and multinational clients across a diverse range of sectors in contentious and non-contentious matters in respect of copyright, trade marks, patent and design protection and enforcement issues.
